Florida (Mesothelioma Cancer News) – A ruling by the Supreme Court in Florida court impact how thousands of asbestos claims will be handled. As reported by the Daily Business Review, the state’s high court is considering how the passage of the 2005 Florida Asbestos and Silica Compensation Fairness Act will affect asbestos claims.
Justice Barbara Pariente is quoted in the report as stating to defense attorney Gary Sasso upon hearing arguments this week, lawmakers “eliminated a class of what they consider to be minor cases… I may not like these claims any more than you do, but it seems courts recognized those causes of action.”
Miami appellate attorney Joel Perwin is further quoted as stating of the impact the law has on cases of claimants who were not deemed ill enough to file suit in accordance with statutes, “Not only were they told to go to the back of the line when they were getting ready to go in, they were kicked out of the line entirely.”
